The humble petition of the above named Complainant, most respectfully;

 

Sheweth as under :

 

1.   That on 26/07/2022, the Complainant’s Learned Advocate did not take any steps in the present Consumer proceedings therefore the Hon’ble Commission was pleased to direct for Show Cause in the present Consumer proceeding upon the Complainant.

 

2.   That in the present unprecedented Pandemic situation, the Learned Advocate could not appear on the said earlier occasion due to his suffering from cold and fever as he was in apprehension of being effected with COVID-19.

 

3.   That your petitioner undertake to take steps and to be present on all and each date of hearing as fix in the present consumer proceedings before the Hon’ble Commission.

 

4.   That your petitioner placed her unconditional apology for absence of her Learned Advocate on earlier dates before the Hon’ble Commission.

 

5.   That in view of the facts as stated above, your petitioner seeks the acceptance of cause shown before the Hon’ble Commission in the interest of administration of Justice.

 

6.   That unless the Hon’ble Commission accept the cause shown, your petitioner will highly prejudice and suffer with irreparable loss and injury.

 

7.   That the balance of convenience and inconveniences are in favour of the petitioner and the opposite party will not prejudice.

 

8.   That this application is made bona-fide and in the interest of administration of Justice.

 

In the given facts and circumstances, it is prayed before the Hon’ble Commission, would graciously be pleased to allow this application and to accept the cause shown by the petitioner in the interest of administration of Justice, and or to pass such other necessary order or orders as your Honour may deem, fit, and proper for the end of Justice.

 

And for this act of Kindness, the Petitioner as in duty bound shall ever pray.

I, Smt. Soma Malla, Wife of Ashis K Ghosh, aged about ____years, by faith Hindu, by Occupation House Wife, residing at premises being no. 20/1, Jugipara Road, Flat C – 1, Debaloy Apartment, Kolkata – 700028, Police Station Dum Dum, District – North 24 Parganas, do hereby solemnly affirm and says as follows :

 

1.   That I am Complainant in the present Consumer Proceedings. I am conversant with the material facts and circumstances of the present Consumer Case. I am competent to swear this affidavit.

Show Cause Petition

 

The humble petition on behalf of the Opposite Party most respectfully;

Sheweth as under :

 

1.           That today (i.e. 14/12/2022), is fixed for the Show Cause by the Opposite Party, in the above referred proceeding, before the Learned Court, as the Learned Court did not find any steps for the opposite party on last occasion.

 

2.           That on 28/09/2022, due to illness of the Learned Advocate of the Opposite Party, no steps has been assailed in the case record. The Opposite Party was not in Kolkata on such occasion, as no leave has been given by the Central Railways Authority. Thus while the Learned Court did not find any steps and appearance of the Opposite Party, the Learned Court was pleased to direct the Show Cause on the Opposite Party.

 

3.           That the Opposite Party is much due diligent in conducting the proceeding before the Learned Court though the illness of the Learned Advocate and non-consideration of leave by the employer of the Opposite party prevent the opposite party to appear before the Learned Court on the given occasion in the proceeding.

 

4.           That the Opposite Party undertake to take all necessary steps and be present in the proceeding on each and every occasion fixed up by the Learned Court.

 

5.           That the Opposite Party is ready with his Written Objection and Annexure – A – being affidavit of assets and liabilities, to place in the present proceeding.

 

6.           That in the given facts and circumstances, the opposite party seeks the acceptance of cause shown by him before the Learned Court, in the interest of administration of Justice.

 

7.           That unless the Learned Court accept the cause shown by the opposite party, the opposite party will highly prejudice and suffer with irreparable loss and injury thereof.

 

8.           That the balance of convenience and inconveniences are in favour of the Opposite Party, and the Petitioner will not prejudice.

 

9.           That this application is made bonafide and in the interest of administration of Justice.

 

It is therefore prayed that your Honour would graciously be pleased to allow this written objection of the Opposite Party and to accept the cause shown by the opposite party, in the interest of administration of justice, and or to pass such other order or orders as your Honour may, deem, fit, and proper for the end of justice.

  1. That the petitioner appeared in one Misc. Case no. ACM-659/2021, before the Learned 4th Court of Judicial Magistrate at Alipore, South 24-Parganas, which has been initiated by the opposite party no.1, against this petitioner, and whereas subsequently, the petitioner filed his Written Objection petition against the interim maintenance petition of the opposite party and thereafter the Learned 4th Court of Judicial Magistrate, taken up the said Misc. Case for hearing and whereas on and after hearing both side of the said Misc. Case matter, the Learned 4th Court of the Judicial Magistrate, passed the necessary order dated 05/07/2022, with a direction upon your petitioner to make the payment of Rs. 4,000/- ( Rupees Four Thousand ) only per month towards interim maintenance to the opposite party herein, from the date of filing of the said Misc. Case.

 

  1. That the Learned 4th Court of Judicial Magistrate, Alipore, South 24-Parganas, passed the Order dated 05/07/2022, in Misc. Case no. ACM – 659/2021, as to direct your petitioner to pay Rs.4,000/- ( Rupees Four Thousand ) only per month towards interim maintenance from the date of filling of the said Misc. Case, within 10 days of every month of English Calender.

 

  1. That the Petitioner state and submits that the Learned 4th Court of Judicial Magistrate, taking all allegations into the consideration as alleged by the Opposite Party no.1, herein though failed to take into account the allegations and facts as has been enumerated and placed by your petitioner in the proceedings before the Learned 4th Court of Judicial Magistrate, at Alipore, South 24 Parganas.

 

  1. That the petitioner states and submits that your Petitioner is presently aged about 29 years old, is only Son of the Opposite Party, who married in the year 2019. The Petitioner is a married person having his Spouse namely Smt. Aparna Mondal, and having a minor male child in the year 2021, namely Sadhvik Mondal. The Petitioner have one Elder Sister namely Smt. Tumpa Mondal, who married in the year 2010, and thereafter she is staying at her matrimonial house at Santoshpur, Kolkata.

 

  1. That the Petitioner states and submits that the petitioner is looking after and caring his old aged mother Smt. Putul Mondal, Grand Mother Smt. Raboti Mondal, who died recently, his Father Sri Kartik Mondal, and his Wife and minor child, out of his earning as Rs. 10,661/- ( rupees Ten Thousand and Six Hundred and Sixty One ) only.

 

  1. That the Petitioner states and submits that the Petitioner and his mother experienced much immoral behavior of the Opposite Party in their life and still experiencing. The Opposite Party is in illicit relationship with one lady, all along, therefore most of his earning spend on his unwarranted choices. The opposite party did not take care of the petitioner and his mother.  The petitioner followed his mother’s word and education to prevail the protection and care of the family members without uttering any words to the opposite party. The Petitioner’s income is much limited and on paper as given by the Employer.

 

  1. Being aggrieved by and dissatisfied with the order dated 05/07/2022, passed by the Learned 4th Court of Judicial Magistrate, Alipore, South 24-Parganas, vide Misc. Case no. ACM-659 of 2021, the petitioner preferred this revision application.

 

  1. That the Petitioner seeks stay of operation or effect of the impugned order dated 05/07/2022, passed in Misc. Case No. ACM-659/2021, by the Learned 4th Court of Judicial Magistrate, Alipore, South 24 Parganas, till disposal of the Revision application before the Learned Court, in the interest of administration of Justice.

 

  1. That unless the Learned Court grant stay of the impugned Order dated 05/07/2022, passed in Misc. Case no. ACM-659/2021, by the Learned 4th Court of Judicial Magistrate, Alipore, South 24 Parganas, the Petitioner will highly prejudice and suffer with irreparable loss and injury, thereof.

 

  1. That the preponderance of balance of convenience and inconveniences are in favour of the petitioner and the Opposite Parties will not prejudice.

 

  1. That the Petitioner, enclosing herewith the Photostat Copy of the Order dated 05/07/2022, passed in Misc. Case no. ACM-659 of 2021, by the Learned 4th Court of Judicial Magistrate, Alipore, South 24 Parganas, for the kind reference in consideration of the Learned Court, and marked as Annexure “C”.

 

  1. That this application of revision made bona fide in the interest of administration of justice.
